Introduction to the Terms of Use Agreement

Welcome to Aliah Tours.

Through this electronic platform, you will find the terms and conditions governing your use of the Platform and the legal implications arising from your use of the travel and tourism services provided through it.

Any individual accessing or using the Platform, whether as a Client seeking tourism services or otherwise, shall be deemed to have accepted and agreed to all provisions of this Agreement and to possess the legal capacity required under applicable laws and regulations. Such use constitutes confirmation of the user's commitment to comply with all terms, conditions, and obligations contained herein.

This Agreement applies to all interactions between the Client and the Platform and shall become effective and legally binding upon acceptance of these terms and commencement of registration or use of the Platform, in accordance with the Electronic Transactions Law applicable in the Kingdom of Saudi Arabia.


Article 1: Introduction and Definitions

The above introduction forms an integral part of this Agreement. The following terms shall have the meanings assigned to them below:

1. Platform

Refers to all forms of the Platform available through the Internet, including websites, mobile applications, and any electronic channels through which travel and tourism services are offered.

2. Client

Any person who interacts electronically with the Platform for the purpose of obtaining travel and tourism services offered through the Platform.

3. Agreement

Refers to these Terms and Conditions, which govern and regulate the relationship between the Client and the Platform.


Article 2: Client Eligibility

  1. The Client acknowledges that they possess the legal capacity required to enter into transactions with the Platform or are at least eighteen (18) years of age.
  2. The Client agrees that any violation of this provision shall make them solely responsible for the consequences arising from such violation toward any third party.


Article 3: Nature of the Platform's Commitment

  1. The Platform's commitment to its Clients is to facilitate and provide the travel and tourism services displayed through the Platform.
  2. The Platform may provide additional services related to the travel and tourism industry, including booking management, travel coordination, customer support, and after-sales services, depending on the nature of the travel service requested by the Client.


Article 4: Acceptable Use

  1. The Client shall use the Platform in compliance with public morals and all applicable laws and regulations of the Kingdom of Saudi Arabia.
  2. The Client shall not use any travel or tourism service booked through the Platform in a manner that violates applicable laws, regulations, or public order within the Kingdom of Saudi Arabia.


Article 5: Accounts and Registration Obligations

Upon registering for an account with the Platform, the Client agrees to provide certain information and to create a username and confidential password for accessing the Platform's services. By doing so, the Client agrees to the following:

  1. To maintain the confidentiality of account information and login credentials and to immediately notify the Platform of any unauthorized use of the account or any security breach.
  2. Under no circumstances shall the Platform be liable for any direct or indirect loss resulting from the disclosure of the Client's username or password.
  3. The Client shall use their account personally and shall bear full responsibility for all activities conducted through it.
  4. The Client undertakes to use the Platform in good faith, responsibly, and accurately.
  5. The Client agrees to provide accurate, current, complete, and lawful information and to update such information whenever necessary.
  6. The Platform shall treat the Client's personal information and contact details with strict confidentiality in accordance with applicable laws and regulations.
  7. By creating an account, the Client agrees to receive notifications and communications relating to bookings, travel services, and tourism-related arrangements. The Platform may also send marketing and promotional communications, and the Client may opt out of such communications at any time through the available channels.
  8. Should the Platform determine that any information provided is inaccurate, incomplete, unlawful, or in violation of this Agreement, the Platform reserves the right to suspend, freeze, or terminate the Client's account without prejudice to any other rights available to the Platform.
  9. Failure to comply with any of the above obligations may result in suspension, cancellation, or restriction of access to the Platform and its services.


Article 6: Electronic Communications and Official Contact Methods

  1. The parties agree that communications may take place via the registered email address, mobile number, or any electronic communication channel approved by the Platform.
  2. The Client agrees that all agreements, notices, disclosures, communications, and other correspondence provided electronically shall have the same legal effect as written communications.
  3. The Client agrees that the Platform may contact them regarding matters related to this Agreement, booking updates, service notifications, or other information relating to services provided through the Platform.


Article 7: Content and Client Contributions

  1. If the Client submits inquiries, feedback, suggestions, ratings, reviews, or comments through the Platform or Aliah Tours' official communication channels, the Client grants the Platform the right to use such contributions for service improvement, operational enhancement, and marketing purposes, without prejudice to the Client's rights or the confidentiality of personal data.
  2. The Client shall not publish or transmit any content that violates applicable laws, public morals, third-party rights, or contains misleading, offensive, unlawful, or inappropriate information.
  3. The Platform reserves the right to remove, edit, reject, or decline publication of any content, review, rating, or comment that violates applicable laws or Platform policies.


Article 8: Amendments to the Terms of Use and Fees

  1. Should any provision or clause of this Agreement become invalid, unenforceable, or cease to have legal effect, such invalidity shall not affect the validity and enforceability of the remaining provisions of this Agreement.
  2. This Agreement constitutes the framework governing the relationship between the Client and the Platform and may be updated or amended from time to time as circumstances require.
  3. The Platform may impose fees in relation to certain travel and tourism services or transactions. Additional taxes, governmental charges, or service fees imposed by competent authorities or travel service providers may also apply.
  4. The Platform reserves the right to introduce, amend, increase, reduce, waive, or remove any fees or charges relating to the services provided through the Platform, as deemed appropriate.


Article 9: Payment and Settlement Services

  1. The Platform provides payment and settlement solutions through its authorized partners. Payments may be completed electronically using the payment methods available on the Platform or any additional payment methods that may be adopted in the future.
  2. Aliah Tours is committed to displaying the prices of travel and tourism services in accordance with prevailing market rates within the tourism industry.
  3. The Platform shall provide invoices, receipts, or other required financial documentation for amounts collected in relation to tourism services and shall provide the Client with a booking invoice whenever applicable.
  4. The Platform shall maintain financial and accounting procedures consistent with recognized standards applicable to the online provision of travel and tourism services and in accordance with this Agreement.


Article 10: Privacy and Confidentiality

  1. Aliah Tours respects the privacy of its Clients and is committed to protecting personal data collected through the Platform in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia.
  2. The Platform may collect information necessary for the provision of travel and tourism services and the management of bookings, including but not limited to:
  • Full Name
  • National ID Number, Residency Permit Number, or Passport Number where required
  • Mobile Phone Number
  • Email Address
  • Travel and Booking Details
  • Information Required to Process Payments
  1. Personal information may be used for operational purposes related to travel and tourism services, including:
  • Processing Bookings and Reservations
  • Issuing Travel Documents and Tickets
  • Coordinating with Hotels, Airlines, and Other Travel Service Providers
  • Communicating with Clients Regarding Booked Services
  • Processing Payments
  • Enhancing Service Quality and Customer Experience
  1. The Platform may share necessary information with service providers involved in fulfilling travel arrangements, including airlines, hotels, transportation providers, tourism suppliers, or relevant governmental authorities, to the extent necessary for delivering the requested services.
  2. The Platform retains personal information for the period required to fulfill operational, contractual, legal, regulatory, or compliance obligations.
  3. Appropriate technical, administrative, and organizational measures shall be implemented to safeguard personal data against unauthorized access, disclosure, misuse, loss, or alteration.
  4. Non-personal, aggregated, and statistical information may be used for service development, business analysis, operational improvement, and enhancement of the user experience.


Article 11: Client Rights Regarding Personal Data

  1. The Client has the right to request access to personal data maintained by the Platform, subject to applicable laws and regulatory requirements.
  2. The Client may request the correction, updating, or completion of inaccurate or incomplete personal information.
  3. The Client may request that their personal data no longer be used for direct marketing purposes where permitted under applicable regulations.
  4. All requests relating to personal data shall be processed in accordance with the laws, regulations, and procedures applicable in the Kingdom of Saudi Arabia.


Article 12: Intellectual Property Rights

  1. All intellectual property rights associated with the Platform are the exclusive property of the Platform, whether acquired before or after its establishment.
  2. The Client shall respect all intellectual property rights relating to the Platform, including the name Aliah Tours, trademarks, service marks, logos, symbols, designs, content, and other materials displayed through the Platform. Such rights are protected under applicable intellectual property laws and regulations.


Article 13: Platform Responsibility

  1. The Platform shall conduct its business activities in accordance with the laws and regulations of the Kingdom of Saudi Arabia and in compliance with the provisions of this Agreement.
  2. The Platform shall not be liable for any claims, losses, damages, delays, disruptions, or negligence arising from the actions or omissions of the Client or third parties, including airlines, hotels, transportation providers, tourism suppliers, or other travel service providers.
  3. Aliah Tours, its management, employees, representatives, and affiliates are committed to providing travel and tourism services in a lawful, professional, and authorized manner in accordance with applicable laws and regulations in the Kingdom of Saudi Arabia.
  4. The Platform reserves the right to report any unlawful, fraudulent, suspicious, or unauthorized activity detected through the Platform to the relevant authorities in accordance with applicable laws and regulations.


Article 14: Restriction or Termination of Membership

The Platform reserves the right to suspend, restrict, or terminate a Client's membership, account, or access to any part of the Platform's services at any time for any legitimate reason, including violations of this Agreement, operational requirements, security concerns, or compliance with applicable laws and regulations.


Article 15: Governing Law and Jurisdiction

This Agreement shall be governed by and interpreted in accordance with the laws and regulations in force within the Kingdom of Saudi Arabia.

Any dispute arising out of or relating to this Agreement, the Platform, or the services provided through it shall be subject to the exclusive jurisdiction of the competent courts and authorities of the Kingdom of Saudi Arabia.


Article 16: General Provisions

  1. The Arabic language shall be the governing language for the interpretation and enforcement of this Agreement. In the event of any discrepancy between the Arabic version and any translated version, the Arabic version shall prevail.
  2. All prices displayed for travel and tourism services on the Platform are subject to change at any time without prior notice unless otherwise stated.
  3. Promotional, marketing, and seasonal offers made available through the Platform are temporary in nature, and the Platform reserves the right to amend, suspend, extend, or discontinue such offers at its sole discretion.
  4. The parties shall conduct their dealings in a manner consistent with applicable laws, regulations, public order, and Islamic principles recognized in the Kingdom of Saudi Arabia.
  5. If any provision of this Agreement is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.
  6. This Agreement may only be terminated by a decision of the Platform's management or as otherwise required by applicable laws and regulations.
  7. Continued use of the Platform following the publication of amendments to this Agreement shall constitute the Client's acceptance of such amendments and agreement to be bound by the updated terms.
